RentCafe Terms of Service

By using RentCafe.com (RentCafe ILS) or any property websites powered by RentCafe (RentCafe Portal) (collectively, “RentCafe”), you accept and agree to be bound by the latest version of the RentCafe Terms of Service (posted at https://resources.yardi.com/legal/rentcafe-terms-of-service/), which are between you and RentCafe (not the property) and will be updated from time to time. The property may have its own terms and conditions that apply between the property and you.

Application Terms & Conditions

1. Application Fee Disclaimer

  • Standard Policy: Application fees are strictly non-refundable, regardless of whether an application is approved, denied, or withdrawn.
  • Purpose: These fees cover the immediate costs of third-party screening and administrative overhead.
  • Integrity Requirement: All fees are considered earned and non-refundable if the applicant provides false or fraudulent information.

2. Legal Terms

  • Binding Agreement: Use of the Site and Services constitutes a legal agreement between the User and the Property Management Company.
  • Governing Law: All legal proceedings shall be governed by the laws of the state and county where the property is located.
  • Liability: The Company and its affiliates are not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Site.

3. Payment Terms

  • Collection Agency: Yardi acts as a limited payment collection agent solely for the purpose of accepting and processing payments for the property.
  • Payment Finality: The applicant's payment obligation is satisfied the moment funds are received by Yardi.
  • Administrative Fees:
    • Discretionary Refunds: Administrative or holding fees may be deemed non-refundable at the Company’s sole discretion, as permitted by service-specific terms.
    • Fraud/Misrepresentation: Administrative fees are strictly non-refundable if an application is denied or cancelled due to the provision of false, inaccurate, or fraudulent information.

4. Registration Terms

  • Account Accuracy: Users must provide and maintain true, accurate, and complete information at all times.
  • Security Responsibility: The User is solely responsible for maintaining the confidentiality of their account, password, and all activities occurring under their credentials.
  • Right to Terminate: We reserve the right to delete accounts and refuse service if an applicant misrepresents their identity or provides untrue information.

5. Screening Terms

  • Consent: Submission of the application constitutes express consent to the screening and background check process.
  • Verification: This process may include identity and document verification through third-party providers.
  • Dispute Resolution: Applicants must address any concerns regarding screening results directly with the screening provider.
